Binani ta janye ƙarar da ta shigar da INEC

A ranar Laraba ne ‘yar takarar jam’iyyar APC a zaɓen gwamnan jihar Adamawa, Aisha Ɗahiru-Ahmed, wacce aka fi sani da “Binani,” ta janye ƙarar da ta shigar a gaban hukumar zaɓe mai zaman kanta ta ƙasa INEC.

‘Yar takarar APC ta yi addu’a ga kotu da ta sake duba hukuncin da INEC ta yanke na sauya shelarta na farko a matsayin wanda ya lashe zaɓen da Kwamishinan Zaɓe na jihar, REC, Hudu Yunusa-Ari ya yi.

Lauyan Misis Binani, Mohammed Sheriff, da ya ci gaba da sauraren ƙarar, ya shaida wa mai shari’a Inyang Ekwo na wata babbar kotun tarayya da ke Abuja cewa an bayar da sanarwar dakatar da hakan inda ya buƙaci kotun ta yi watsi da ƙarar.

Mai shari’a Ekwo ya tunatar da Sheriff cewa an bayar da umarnin a ranar da aka ɗage zaman na ƙarshe inda aka umurce shi da ya yi magana a kotu kan ko kotu na da hurumin sauraren ƙarar ko a’a. Lauyan wanda ya shaida wa kotun cewa batutuwa da dama sun taso tsakanin ranar da aka ɗage shari’ar zuwa yau, ya roƙi a ba su umarnin soke ƙarar.

Sai dai alƙalin kotun ya ce tunda Sheriff ya gaza bin umarnin kotu, abin da ya dace ya yi shi ne ya yi watsi da batun. “Na ba da umarnin yin watsi da wannan ƙarar,” in ji Justice Ekwo.

NAN ta ruwaito cewa alƙalin kotun, a ranar 18 ga watan Afrilu, ya ƙi sauraron ƙarar da Binani ta shigar da tsohon ɓangaren. Ekwo, a maimakon haka, ya umarci lauyan ɗan takarar na APC da ya yi magana a kan batun shari’a kafin ya saurari gamsassun ƙudurin.

Alƙalin ya ce duk da cewa a shirye yake ya saurari Sheriff, amma sai lauyan ya yi magana a kan batun shari’a kafin ya ci gaba. Ya ce za a ɗauki takardar ne tare da batun shari’a a ranar da za a ɗage ci gaba da sauraren ƙarar har zuwa ranar 26 ga Afrilu don sauraron ƙarar.

Amma a ranar 19 ga Afrilu, alƙalan zaɓen sun ayyana jam’iyyar Peoples Democratic Party, ɗan takarar PDP da Gwamna Ahmadu Fintiri a matsayin wanda ya lashe zaɓen gwamna da aka gudanar a jihar.

Misis Binani da APC, a cikin ƙudirin tsohon jam’iyyar mai lamba: FHC/ABJ/CS/510/2023, sun kai ƙarar INEC, PDP, da ɗan takararta, Gwamna Fintiri a matsayin masu amsa na 1, 2, da na 3.

Misis Binani, ta bakin lauyanta, Hussaini Zakariyau, SAN, ta buƙaci a sake duba hukuncin da hukumar zaɓe ta INEC ta yanke a ranar 16 ga watan Afrilu dangane da ayyana ta a matsayin wanda ya lashe zaɓen gwamna da aka gudanar a ranar 18 ga watan Maris da kuma ƙarin zaɓen da aka gudanar a ranar 15 ga watan Afrilu.

Ta kuma nemi a ba ta umarnin haramtawa INEC da jami’anta ɗaukar wani mataki na gaba wajen bayyana wanda ya lashe zaɓen har sai an kammala tantance buƙatar ta na neman shari’a.

An kawo aikace-aikacen a ƙarƙashin Dokokin 34 na 1a, Order 3(1) & 3(2) a, b, c, Order 6 na Babban Kotun Tarayya (Dokokin Tsarin Mulki), 2019, da Sashe na 251 (1)q & r na Kundin Tsarin Mulki na 1999, da kuma Sashe na 149 & 152 na Dokar Zaɓe, 2022.

Da yake bayar da dalilin amincewa da ƙudirin, Binani ya bayyana cewa bayan kammala tattara sakamakon zaɓe, INEC ta bayyana ta a matsayin wadda ta lashe zaɓe amma jam’iyyar PDP da ɗan takararta, Gwamna Fintiri suka fafata rikici tare da tayar da hankulan jama’a wanda ya kai ga duka da kuma sarrafa ma’aikatan INEC.

Wannan rikicin, inji ta, ya sa INEC ta soke sanarwar farko da ba ta da hurumin yi domin kotun sauraren ƙararrakin zaɓe ce kaɗai ke da irin wannan iko. Da soke sanarwar ta, Misis Binani ta ce INEC ta ƙwace ikon kotun sauraron ƙararrakin zaɓe wadda ita ce kotu ɗaya tilo da ke da hurumin bayyana gudanar da zaɓe.

A cikin aikace-aikacen, ta yi watsi da cewa an sake nazarin shari’a don baiwa kotun ƙoli damar bincikar ayyuka da hukunce-hukuncen kotunan ƙananan hukumomi da kuma ɓangaren majalisa da gudanarwa na gwamnati ciki har da hukumomi da jami’an gwamnati.

Mai neman ya ƙara da cewa hukumar INEC a matsayinta na hukumar gwamnati, za ta iya tantance ayyukanta da bayananta da kuma hukunce-hukuncen da kotu ta yanke, kuma kotu ce kaɗai za ta iya soke abin da wani jami’in INEC ya yi ba wai ita kanta INEC ba.
